Event General Release
BIG HORSE RESCUE EQUINE EVENT TERMS AND CONDITIONS
By purchasing a ticket to, registering for, or participating in Big Horse Rescue Hoedown, you agree to the following terms and conditions:
A. ACKNOWLEDGMENT OF RISK
a. I knowingly, willingly, and voluntarily acknowledge the inherent risks associated with equestrian activities and exercises, and the equestrian sport and am fully aware that equestrian care, equestrian activities, and horseback riding are inherently dangerous; and that participation in the handling, care and treatment, training, or exercise of equine involves risks and dangers including, without limitation, the potential for serious bodily injury (including broken bones, head or neck injuries), sickness and disease (including communicable diseases), trauma, pain & suffering, permanent disability, paralysis and death; and even loss or damage to personal property arising from unpredictable behavior of horses; exposure to extreme conditions and circumstances; potential for injury from accidents involving other volunteers or participants, event staff, spectators; contact or collision between other participants and/or with horses, adverse weather conditions; facilities issues and premises conditions; failure of protective equipment; inadequate safety measures; participants of varying skill and experience levels; situations beyond the immediate control of the equine handlers or volunteers; and other undefined, not readily foreseeable and presently unknown risks and dangers.
b. I knowingly, willingly, and voluntarily acknowledge the inherent risks associated with participating in an outdoor fairground event, including the risk of personal injury, death, or property loss.
B. ASSUMPTION OF RISK
a. I understand that Risks of equestrian activity may arise or be caused in whole or in part, or result directly or indirectly, from my own actions or inaction, or from negligence, action or inaction of others that participate in equestrian operations, activity or events involving BIG HORSE and its equine and/or its operations, or the negligent acts or omissions of other Released Parties; and
b. I hereby voluntarily, willingly, and knowingly assume all such Risks and responsibility for any injury, damages, liabilities, losses, or related expenses that I incur related to my participation in any of the operations, activities, or events arising from or offered by BIG HORSE. I also agree to be responsible for any injury or damage caused by me, my actions or inaction, or for persons under my direct supervision and control at BIG HORSE events, activities, or on BIG HORSE properties.
C. WAIVER AND RELEASE OF LIABILITY, AND HOLD HARMLESS
a. I hereby release, waive and covenant not to sue, and further agree to defend and hold harmless, the BIG HORSE RESCUE CORP., for any loss, damage, personal injury, or liability arising from my participation in the operations, activities, and events offered by BIG HORSE, whether such incidents, losses, injuries or damage may occur on property owned or leased by BIG HORSE, or on property that is temporarily used or accessed by BIG HORSE for its operations, showing, events, or activities associated with the organization's business or purpose, which arise from, result from, or in any manner relate to my action or inaction or participation in equestrian activities on behalf of BIG HORSE Rescue Corp., including claims for Liability caused in whole or in part by the negligent acts or omissions by Released Parties.
FLORIDA STATUTES § 773.02 GENERAL PROVISIONS
Except as provided in s. 773.03, an equine activity sponsor, an equine professional, or any other person, which shall include a corporation or partnership, shall not be liable for an injury to or the death of a participant resulting from the inherent risks of equine activities and, except as provided in s. 773.03, no participant nor any participant's representative shall have any claim against or recover from any equine activity sponsor, equine professional, or any other person for injury, loss, damage, or death of the participant resulting from any of the inherent risks of equine activities.
Event Photo Release
By entering, registering for or participating in an event or position, I hereby grant to BIG HORSE RESCUE, CORP (BHR), a non-profit organization, the irrevocable, worldwide, and unrestricted right to use, reproduce, publish, distribute, and publicly display photographs of me, or in which I may be included, in any and all forms of media now known or hereafter developed, including but not limited to print publications, digital publications, websites, social media, promotional materials, and public presentations. I understand and agree that these photographs may be edited, altered, or modified at BHR's discretion. I hereby waive any right to inspect or approve the finished photographs or any printed or electronic matter that may be used in conjunction with them. I hereby release and discharge BHR, its officers, employees, volunteers, licensees, and legal representatives from any and all claims and demands arising out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. I understand that no royalty, fee, or other compensation shall become payable to me by reason of such use.
